Accidents involving drivers
Drivers must take reasonable care whilst passing or approaching horses or ponies, whether the animals are being ridden or led. A surprisingly large number of accidents occur due to the impatience of drivers who believe they are being held up by a slower moving horse and rider, and perform unsafe overtaking manoeuvres too close to a horse, causing it to bolt.
Accidents in competitions
Organisers of riding competitions owe duties to competitors and spectators to take reasonable steps to prevent accidents occurring.
A loose or frightened horse can cause physical damage to people and property, and the owner or rider can in some circumstances be liable under the Animals Act 1971 and under the general rules governing negligent behaviour.
